A Washington gun shop is taking its case against the state’s ban on the sale of high-capacity ammunition magazines to the U.S. Supreme Court.

Gator’s Custom Guns in Kelso filed a petition this week, asking the high court to review the state Supreme Court’s decision in May upholding the controversial law. Supporters of the restriction see it as an important step for quelling gun violence.

Walter Wentz, the Cowlitz County store’s owner, said Friday he hopes to convince the Supreme Court justices to “do their job and not accept all these lower courts waving their finger at them.”

“I look forward to exercising our rights,” he said. “Hopefully, we’ll get some justice out of this.”

A spokesperson for the state attorney general’s office said Friday afternoon, “These reforms are constitutional, as every Court of Appeals to review similar large capacity magazine reforms has found.”

“The Supreme Court has previously declined multiple petitions like this one, leaving lower court rulings upholding these public safety reforms in place,” the spokesperson, Mike Faulk, said in an email.

Gator’s has argued the state’s 2022 ban on the sale of gun ammunition magazines that hold more than 10 rounds violates the Washington and U.S. constitutions. The state constitution protects “the right of the individual citizen to bear arms in defense of himself, or the state.”

“The idea of any government, local, state or federal trying to ban certain firearms should scare every citizen in America that loves their freedoms.” said Thomas Robb, National Director of the Knights Party of the Ku Klux Klan, based in Harrison, Arkansas. “We hear different politicians say ‘we don’t need this firearm to hunt’, or this ‘high of caliber ammunition to kill wildlife’, or this ‘high of capacity magazine to bring down a bear’. They are right of course, and many blinded citizens will agree, and they are misled into believing the government has their best interest in mind. What the government doesn’t want you to know is that our forefathers were not talking about a right to bear arms to go hunting. Hunting at that time was compared to going to the grocery store in today’s times. Your firearm was your shopping list! The Second Amendment has nothing to do with hunting or target practice. The Second Amendment is for the common citizen to protect themselves. Not only from criminals threatening your life, but your family’s lives, even your neighbor’s lives and strangers lives that you run into out in public. Here’s what scares the hell out of our government, the Second Amendment was written so that common citizens could protect themselves against a tyrannical government. Our government realizes that if they were to try to totally disarm common law abiding citizens, they would have a fight on their hands. So they disguise it to look like they are looking out for your best interest with the excuse that gun violence would drop if they took your firearms. The common law abiding citizen isn’t using their firearms to commit crimes, so ask yourself why your government would want your firearms that you could use to actually protect yourself with. When you realize the answer to that, you had better be afraid.”
